St. Croix, V.I. – Attorney General Denise George announced that Kyle Christopher and Delicia Daniel were arraigned today in the Superior Court of the Virgin Islands on the formal criminal charges filed by the Attorney General against them in the death of 4-year old Aaron Benjamin.
The Criminal Information, which is the formal charging document filed by the Attorney General for prosecution of the case, charges the Defendants with Murder in the First Degree (4 counts), Child Abuse (2 counts), Child Neglect (2 counts), Aggravated Child Abuse and Neglect (2 counts), Assault in the Third Degree (2 counts).
If convicted for Murder in The First Degree, the defendants face imprisonment for the remainder of his/her natural life without parole. For Child Abuse, they face a fine of not less than $500.00, or by imprisonment of not more than 20 years or both. For Child Neglect, they face a fine of not less than $500.00, or by imprisonment of not more than 15 years or both. For Aggravated Child Abuse and Neglect: Imprisonment of not less than 5 years but not more than 30 years and for Assault Third Degree, a fine of not less than $500.00 and not more than $3,000.00, or imprisonment of not more than 5 years, or both.
At arraignment, the Defendants entered a plea of not guilty to all charges for the death of Benjamin that occurred on October 11, 2019.
Attorney General George cautions the public that the Criminal Information is a charging document, and the defendants are not guilty of the offenses charged unless or until they are proven beyond a reasonable doubt in a court of law.
